Terms & Conditions
These terms and conditions may be subject to change at any time, without notification by Kickdown.
Tickets to the Event are sold or given and admission to the Event is granted on the express condition that you are bound by these Event Terms and Conditions and any other rules and regulations issued by the Promoter (Event T+Cs). By purchasing an Event ticket, you agree to be bound to the Event T+Cs.
This Event is run by Kick Down NZ.
General Conditions of Entry
By purchasing tickets for Kickdown, you are agreeing to abide by their respective terms and conditions, including conditions of entry. Violating these conditions of entry may result in denial of entry, immediate ejection, or referral to the New Zealand Police if deemed appropriate.
Kickdown events are strictly R18 and consequences in accordance with New Zealand liquor licensing laws we will only permit entry with these three valid forms of identification:
- HANZ 18+ ID Card
- New Zealand drivers licence
- Passport (must be current)
There will be no exceptions made to this policy in accordance with New Zealand law, with the name on the ID needing to exactly match the name on the e-ticket at time of purchase. Attendees who do not present the valid form of identification will be asked to leave and escorted off-site if required, with no refunds provided.
All attendees on-site must comply with all the directives in the event of emergency evacuations or situations.
Those believed to be attempting to contravene these regulations or assist others in breaking these conditions of entry (including admittance of those without valid tickets) will be denied access to the site and referred to the New Zealand Police if required.
All attendees on-site must have a valid form of admittance, which must constitute one of the following forms (but not limited to):
- A valid and non-redeemed ticket prior to admittance
- A valid media/other authorised person accreditation
Event Tickets: Entry to the Event Site will be granted with presentation of:
- A valid bar-coded ticket; or
- A valid bar-coded print at home PDF ticket; or
- A valid bar-coded passbook ticket (electronic ticket on mobile device),
issued by an Authorised Ticketing Agency.
An Authorised Ticketing Agency means each of: (1) Flicket Ltd (Flicket); and (2) any independent ticketing outlet as authorised an approved by the Promoter.
Lost Tickets: replacement is not available for lost, destroyed or stolen event tickets unless proof of purchase is presented.
By attending this event you are providing perpetual permission to be filmed, photographed or used in any promotional material by Kickdown.
Kickdown takes no responsibility for personal items on-site, including tickets.
Kickdown events are open air events in rural venues. Consequently, entry is at the attendees own risk and attendees assume that there may be risks inherent in admission to the venue Both event and owners of the venues will not be held responsible in the event of any injury, loss or damage sustained entering the venue, including the entry of private vehicles into on-site or adjacent car-parking facilities.
It is strictly forbidden to walk along designated bus and state highway areas between Kickdown and other areas. This is extremely dangerous for the individual, buses and other traffic, and may result in immediate removal from the festival or referral to the New Zealand Police.
If at any point, you feel that you or others health or safety is threatened, you should contact the nearest security guard. In addition, first aid staff will be positioned onsite who can be contacted by security.
Any attempts to misrepresent oneself as a member of security, staff, or other personnel through the use of high-visibility clothing or making statements as such will be considered a serious offence and the party will be immediately ejected from the event.
Ticket Restrictions: You agree not to re-sell Event tickets contrary to applicable law. Even tickets may not, without the prior written consent of promoter;
- Be re-sold or offered for resale fat a premium (including via online auction sites) or;
- Used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or;
- Used to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer.
If an event ticket is used in breach of this condition, the Event ticket may be cancelled without a refund and the bearer of the event ticket may be refused admission. The Promoter will use reasonable efforts to notify you of such action.
Ticket Purchase Limits: The promoter reserves the right to enforce published ticket purchase limits and cancel any tickets obtained above said limits in any one transaction or by any one customer. If you exceed the stated ticket limit, you may have all or any of your order and tickets cancelled without notice by Promoter in its discretion. This includes orders associated with the same name, email address, billing address, credit card number or other information.
Conditions of entry: Kickdown will not permit the entry of attendees who break the following conditions of entry and will eject those who break these rules, at their discretion without warning with no refunds provided. Items deemed to be in violation of these conditions of entry will be confiscated and not retuned.
- No alcohol is allowed to be brought in to the festival venue and campground.
- No Glass (jars, bottles, containers, mirrors and perfumes)
- No anti-social or threatening behaviour to other festival attendees or staff, or behaviour deemed to be violent of the intent of these terms and conditions.
- No misrepresentation as a member of staff or security or attempt to enter restricted areas.
- No gang patches or gang paraphernalia
- No construction or attempts to do so of any form of fire or bonfire or use of naked flame.
- No gross intoxication
- No animals on-site
- No use of illicit drugs or illegal substances
- No attempt to bring into the venue any of the following items (but not limited to)
- Illegal drugs or substances
- Air horns
- Fireworks, flares, sparklers explosives or any fire twirling equipment.
- Flammable liquids
- Instruments
- Advanced personal vaporizers (or modified APVs) or liquid refills for E-Cigs
- Sound systems
- Weapons or explosives of any kind (including potential missiles)
- Nitrous oxide bulbs and canisters
- Portable Laser equipment and pens.
- Couches and chairs
- Anything studded (i.e. belts, wristbands)
- Any form of glass, including glass containers and/or drink vessels
- BBQs or cookers of any sort
- Inappropriate drinking apparatuses such as funnels, bongs, scrumpy hands etc.
- Materials to construct fires or weapons
- Other dangerous items
- Kits or sky lanterns
- Unauthorized solicitation materials including handbills, flyers, stickers, beach balls, giveaways, samples or other promotional items.
- Toy guns, water guns or slingshots
- Skateboards, scooters, wagons, carts, rollerblades, roller skates, bicycles, quadbikes, Segway’s, hover boards, self-balancing scooters or any personal motorised vehicles.
- Eskies and coolers
- Umbrellas
- Any other item deemed by event staff (in their discretion) to be dangerous or offensive or potentially dangerous by event organisers.
- Attendees must allow authorised staff to search their clothes, bags, containers or other possessions for items in violation of these conditions of entry.
- If you do not consent to such searches, you may be denied entry on-site without refund. Prohibited items include but not limited to the list of items above. Confiscated items will not be returned, replaced or reimbursed and proceeds from confiscated items (if any) will be donated to a charity. Promoters reserve the right to refuse entry to any persons.
- Participating in dangerous activities such as aggressive dancing, stage diving, crowd surfing or climbing may result in denial of entry, immediate ejection or referral to the police if deemed appropriate.
Camp ground conditions of entry: Kickdown campgrounds will not permit the entry of attendees who break the following conditions of entry and will eject those who break these rules at their discretion without warning, with no refunds provided. Items deemed to be in violation of these conditions of entry will be confiscated and not returned.

- No food may be brought into the camp ground, there will be food stalls for you to purchase from.

While reasonable care will be taken, Kickdown and the owners of the festival site will accept no liability for any injury or damage that may result in injury or damage to the campers and / or their property. If you suffer injury, by agreeing to these terms and conditions you waive your right to issue or instigate legal proceedings to recover compensation for injury, damage or both.
Ticket refunds, sales and exchanges: Kickdown has a strict no refund policy, if you deem that you have a legitimate reason to ask for a refund, this will be reviewed. It is however unlikely that this will result in any kind of funds being transferred back to the ticket purchaser.
All attendees acknowledge that, as at the time of ticket purchase, there is a respiratory illness outbreak caused by a novel coronavirus (COVID 19) that is impacting various regions globally. The attendees agree that where it is impossible or unreasonably impractical for the event to take place due to any cause or event in connection with the COVID-19 pandemic that is not reasonably within the control of the event then the Performance will be cancelled and the event and attendee shall have no further liability to each other, and the event will refund any monies paid to the attendees less any reasonable administration and cancellation and set up costs up to and not exceeding 50% of the gross ticket price.
Kickdown is an all-weather event, and will not be cancelled in the event of adverse weather. Efforts will be made to adjust for adverse weather where possible.
In the event that the date of the event is postponed, reasonable efforts will be made to advise ticket holders of the change in dates and how tickets can be redeemed on the amended dates.
Tickets purchased for the event are for Kickdown, not for specific artists or acts. The Promoter reserves the right to change, add, withdraw or substitute artists in the event line-up, vary the advertised program, vary the date and/or vary the event site without prior notification and deny admission to the event site (including admission to a particular performance at the event site) with reasonable cause. No refunds or other compensation will be given if an advertised artist or act changed, cancelled or the length or content of their performance is changed. Subject to this clause, the promoter is not liable for any loss, damage or compensation as a result of the event being cancelled, postponed, relocated or changed for any reason.
There will be no refund of any unused portion of an Event Ticket if you or your invitees are asked or forced to leave the event for any of the reasons set out in the Event T+Cs or if you decide not to attend the event. You are responsible for checking the age minimum for the event. No refunds will be processed if you are denied entry due to not having valid ID for admittance to the Event Site.
Tickets may not be used as part of promotional giveaways, or contests, sweepstakes or in exchange for service unless with the express written consent from Kickdown.
Tickets will only be permitted to be sold and transferred through authorized vendors at a time to be decided by Sundown. As all tickets will be personalized e-tickets. Tickets that have not been transferred correctly to the paying party will not be able to be redeemed by the purchaser with the name transfer of the ticket, with no refund provided.
If the amount paid for a ticket is incorrect regardless of whether it was an error in price or otherwise communicated, Kickdown reserves the rights to cancel that ticket and refund the amount paid. This will apply regardless of whether it was a human error or system malfunction.
In the event of a refund of any sort, the service fee component or other administrative charges in purchasing / delivering the ticket will not be refunded.
If tickets are distributed via authorized postal or other means, Kickdown takes no responsibility for them once they have arrived. If they are lost, stolen or damaged, they will not be replaced.
In the event of the liquor licensing laws are changed, the changes relevant will be notified to festival attendees. However, refunds will not be provided in this instance.
If you do not receive a confirmation email after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm whether or not your order has been place. Only you may be aware of any problems that may occur during the purchase process. Kickdown will not be responsible for losses (monetary or other wide) if you assume that an order was not place because you failed to receive confirmation.
Personal Information: Pursuant to your book, promoter may need to collect and keep personal information about you including your name, address, credit card or payment details, telephone number and the names of all ticket allocations. Unless you tell us otherwise, Promoter may disclose your contact details to third parties if you elect to receive such information at time of ticket purchase so they can provide you with promotional material about other events and products. Promoter may also need to disclose your personal information as required by the law as permitted under the Privacy Act 1993. Please note that all payment information is handled by Windcave (Payment Express) and subject to their T+C, no information on credit cards is collected or stored by Flicket Ltd.
Third Party Vendors: By using third party vendors on-site including but not limited to ticket agents or other vendors associated with Kickdown, you are agreeing to abide by their terms and conditions and any associated responsibilities.
Kickdown will not be held responsible for the actions of third party retailers, or provide refunds in the event of a dispute.
Photographing and/or Recording of the Event by you: personal digital cameras are permitted at the event. SLR cameras are permitted but professional photography equipment (e.g. telephoto lenses; any lens over 20cm; any detachable lens) is not permitted without Promoter-issued media accreditation. Event staff will determine in their discretion whether equipment is considered to be professional photography equipment. Photos of artists and/or the event are permitted only on the basis that:
- Images are only used for private and personal use; and
- Images cannot be made available for sale and/or public display.
Recording or filming the event is strictly prohibited.
Kickdown reserves the right to confiscate and/or delete any footage, recordings and/or photos created by unauthorized or prohibited recording, filming or photography.
Recording and photography of the event by Kickdown: you consent to be included in official photography, film and sound recordings of the event and for these recordings to be used by Sundown and/or any of its authorized representatives and contractors in any medium or context without further authorization by, or compensation to you.
Restricted Capacity: You acknowledge that there may be restricted capacities at some of the Events stages or venues. Once the maximum capacity is reached in these areas there will be no further admissions. Your purchase of a ticket to the Event does not guarantee admission to these areas in such cases.
No Pass outs: Pass outs will not be issued unless otherwise stated.
Animals are not permitted at the event site; service animals are permitted.
Smoking Policy: Venues and stages on and within the event site may operate a no smoking policy and you must comply with any such policy.
Your Behaviour: You must ensure that you and your invitees act in an orderly manner when attending the Event Site. Promoter may refuse entry or evict you or an of your invitees if you or any of your part are behaving in a disorderly, offensive or inappropriate manner.
Alcohol: The event is fully licensed – please do not bring alcohol with you as it will be confiscated and will not be returned. Only alcohol purchased from bars at Kickdown may be consumed on-site. If you wish to purchase or consume alcohol, you must have valid proof of age photo ID. You must be of legal age (18 years) to purchase and consume alcohol on-site. If you are found supplying or buying alcohol for a minor (a person under 18 years of age) you will be evicted from the event and may be referred to New Zealand police.
All bus stops and within the bus station at Aickin Road will be a strict no alcohol consumption any person with unruly behavior or intoxicated will be refused admission on to the bus no refund will be will be issued.
Liquor Ban: Whangamata township has town wide liquor ban. You must comply to this at all times and obey the local liquor ban rule. Any one in breach of the liquor ban, consuming or in possession will be required to dispose of appropriately and immediately.
No food or drink will be permitted into Kickdown. Sealed plastic water bottles (with or without contents) cannot be brought on-site. Unsealed EMPTY plastic water bottles (no glass) can be brought in to Sundown.
If you are found supplying, consuming or in possession of illicit drugs you will be removed from Kickdown and may be referred to the New Zealand police.
Motorbike Parking: Motorbikes are permitted to be parked in your camp site while on the farm. Safety rules apply when riding through campsites. Have fun, be responsible, and safety always comes first.
Signage: You are not permitted to display trading signs on the Event site without prior written consent of Promoter.
Promoter Liability: The service provided by Kickdown will be rendered with due care and skill to the extent required by Part 4 of the Consumer Guarantees Act 1993. Apart from such statutory liability, Kickdown and the owner and/or lessee of the event site will not be liable or responsible for any injury, damage or loss suffered or incurred by you or any person entering or when you enter or are on the event site whether caused by the negligence of Kickdown or that of the owner and/or lessee of the event site (or their respective employees, contractors or agents), whether arising in tort, contract, bailment or otherwise – all such injury loss or damage to person or property is at your own risk.
Indemnity: you agree to indemnify Kickdown and the owner and/or lessee of the Event site against any loss or damage.
Kickdown and/or event site owner and/or lessee may suffer arising out of your negligence or breach of the Event T+Cs.
Release: To the full extent permitted by law, you waive all legal rights of action against and fully release Kickdown and owner or lessee of the Event site (and their respective executive members, directors, officers, employees, volunteers, contractors or agents) from any liability for any loss, damage, personal injury, death, economic loss or consequential loss for any default, failure or negligence (to the extent permitted by law) in relation to entry to and presence on the event site.
Risk: Entry to the event site is at your own risk. Without limiting the generality of this:
- Appropriate footwear and clothing must be worn at all times at the event site;
- You must not most, crowd surf or stage dive;
- Ear plugs should be worn if necessary.
To the extent permitted by law, Kickdown takes no responsibility for any hearing damage or loss caused by excessive noise or injury caused by your failure to follow Promoters directives. In the event of injury or illness Promoter may, at your cost arrange medical treatment and/or emergency evacuation as deemed essential for your safety.
Enforceability: Any provision of these Even T+Cs which is or becomes unenforceable shall not invalidate the other provisions of these Event T+Cs.
